STOCKHOLM, May 9, 2020 / PRNewswire / – A former employee filed a complaint against C-RAD AB claiming compensation for an invention made during employment. C-RAD firmly rejects the trial and considers that the demand for compensation is very excessive, if not at all legitimate.
The invention was patented when the former employee was employed in the C-RAD group and the patent rights are held by C-RAD Positioning AB. In principle, the right to compensation as such is not contested. C-RAD offered a lump sum for the total compensation to the former employee, in accordance with market practice, which was also confirmed by a leading legal expert on compensation in the field of intellectual property.
The former employee claims compensation of 21.9 MSEK, which alone is estimated to be more than 50 times market practice. In addition, the former employee wants a royalty of five percent of the sales generated by the products based on the invention. In the opinion of C-RAD, the complaint is extremely exaggerated and completely unrealistic, even in no way legitimate.
“I am very confident that the offer made by C-RAD is very reasonable based on applicable law and market conditions. Based on all of the legal feedback, we have obtained a claim of the magnitude that it far exceeds market standards. ” says Tim thurn, CEO of C-RAD
This is the fourth in a series of disputes with the company where the consideration was either the same former employee or the company Beamocular AB (owned by the former employee and now bankrupt) for which he was CEO. In the three previous cases, C-RAD prevailed. One of the cases has been appealed and the appeal is pending before the Patent and Market Court of Stockholm.
